By clicking the send button below, applicant affirms that the
above statements are true and correct and hereby authorizes the landlord to verify and
continuously update any and all information provided now or during the pendency of the
occupancy, and this authorization shall continue until all balances owed are paid in full.
An investigation concerning the information contained in this application
will be conducted for the primary and secondary applicants and any occupants
eighteen (18) years of age or older who will reside in the unit, hereafter
collectively referred to as the "parties to this rental application."
Scope: The parties to this application understand that this investigation may
include, but is not limited to, character, criminal and civil history, records
of arrest, rental history, employment/salary history, licensing and vehicle records
along with any other information landlord deems necessary.
Right to assign: The parties understand and agree that this
right to investigate may be assigned to third parties deemed necessary to aid in
recovery of charges due and unpaid.
Authorization: The parties to this application understand and agree that any person,
company, organization, or government agency mentioned in this application are
authorized to verify the truth of any information furnished herein.
Right to reject: The parties to this application understand and agree that, if in the sole
opinion of the landlord, the results of this investigation are unsatisfactory,
any offer of residency may be withdrawn, and this application rejected.
Warranty: The parties to this application hereby warrant the truth of all information
contained in this application in its entirety, and further recognize that any
falsification on this application, whether or not intentionally made, shall be
sufficient cause to deny acceptance of this application, or shall be considered
as a breech of the written lease agreement and shall result in immediate
termination of of tenancy.
Release and indemnification: The parties to this application
hereby expressly release the landlord, its employees and agents, and any procurer
or furnisher of information from any liability whatsoever in the use, procurement, or
furnishing of such information. Further, the parties to this application agree to indemnify
and defend the landlord, its employees and agents from any and all claims arising from or
through the forgoing release of liability.
Disclosure Policy: The parties to this application understand
and agree that any information furnished on this application may be provided to local,
state, or federal governmental agencies, including, without limitation, various law
enforcement agencies.
Application fee: The parties to this application understand that it
will not be considered until the application fee has been received by the landlord.
Refund Policy: Should this application be rejected by the landlord, all monies paid shall
be refunded to the applicant except for the application fee which shall be retained by the landlord.
Forfeiture Policy: Should this application be accepted by the
landlord and the tenant subsequently fails to execute a lease and take occupancy, all
monies paid shall be forfeited as liquidated damages. In addition, landlord shall be entitled
to recover additional damages for rent loss during the application period.
The parties to this application have read and understand the above statements
and conditions to residency, acknowledge that the thirty-five ($35.00) Dollar
application fee is nonrefundable, and agree that to be bound by all rules,
regulations, policies, and procedures that are in force and effect at the time
of application for residency or that may later be adopted.
